1. About the App and Operator

The AquaPlane App (“the App”) is developed and operated by BLUEECHO MARINE – FZCO, a Free Zone Company registered in Dubai, United Arab Emirates. The App is available on the Apple App Store and Google Play Store.

2. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, do not download or use the App.

These Terms constitute a binding agreement between you and BLUEECHO MARINE – FZCO. Apple Inc. and Google LLC are not parties to this agreement and have no obligation to provide support or handle claims related to the App.

3. Licence to Use the App

Subject to these Terms, BLUEECHO MARINE – FZCO grants you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on a device you own or control, in connection with an AquaPlane product you own or are authorised to use. On iOS devices, this licence is further subject to the Usage Rules set out in the Apple Media Services Terms and Conditions.

You may not:

Copy, modify, distribute, sell, or sublicense any part of the App
Reverse engineer, decompile, or attempt to extract the source code
Use the App for any unlawful or unauthorised purpose
Interfere with or disrupt the App or its connected services

4. Account Registration

4.1 Eligibility

You must be at least 18 years old to create an account and accept these Terms. Users aged 13 to 17 may use the App only with the consent and supervision of a parent or legal guardian, who accepts these Terms on their behalf and remains responsible for their use of the App and of any AquaPlane product. The App is not intended for children under 13.

AquaPlane products are underwater propulsion devices. You confirm that you meet any minimum age, certification or supervision requirements that apply to the operation of such products where you use them.

4.2 Your Account

Certain features require you to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at danish@iaquagroup.com if you suspect unauthorised use.

You must provide accurate and current information when registering. We reserve the right to suspend or terminate accounts that contain false information or that are used in breach of these Terms.

5. Compatible Products and Device Pairing

The App is designed for use with AquaPlane-branded underwater scooters and DPV products (including Mantis, Barracuda, and future supported models). Functionality depends on Bluetooth or wireless connectivity between your mobile device and your AquaPlane product.

BLUEECHO MARINE – FZCO does not guarantee compatibility with all mobile device models or operating system versions. Minimum system requirements will be specified on the App Store listing and updated as necessary.

6. Camera, Media, and Sharing

6.1 Camera and Photo Library Access

The App requests access to your device camera and photo library to enable you to capture and attach photos and videos to your dive session records. You will be prompted to grant these permissions when you first use media features. You may revoke these permissions at any time through your device settings, which will disable the relevant features.

6.2 Photos and Videos You Capture or Upload

Photos and videos you capture or upload via the App:

Are stored securely on our servers as part of your session records
Remain your property — you retain all rights to your own media
May be deleted at any time through your account settings
Are not shared with other users or made publicly visible within the App without your explicit action

6.3 Sharing Within the App

The App allows you to share access to your devices and individual dive sessions with people you invite by email, at the access levels described in the App. When you share, the recipient can view the session data, route, charts and any media attached to what you shared. Shared media remains stored on our servers and is displayed to the recipient in the App.

You are responsible for who you invite and for what you choose to share. You may revoke any share at any time. We are not responsible for what a recipient does with content you have chosen to share with them, including if they capture, copy or redistribute it outside the App.

You are solely responsible for ensuring you have the right to share any content you upload or distribute, including that it does not infringe any third-party intellectual property rights, privacy rights, or applicable laws.

6.4 Acceptable Media Content

You agree not to capture, upload, or share through the App any content that:

Is unlawful, defamatory, obscene, or harmful
Infringes the intellectual property or privacy rights of any third party
Depicts minors in an inappropriate or unsafe context
Constitutes harassment, abuse, or threatening material

We reserve the right to remove any media that violates these Terms and to suspend or terminate accounts responsible for such content.

7. App Features and Availability

The App provides product control, session monitoring, dive history, media capture and sharing, and related features. The App may also include firmware update management. Features may vary by product model and may change with App updates.

We reserve the right to modify, suspend, or discontinue any feature or the App itself at any time. BLUEECHO MARINE – FZCO is not liable for any loss resulting from changes to or unavailability of the App.

8. Firmware Updates

The App may deliver firmware updates to your paired AquaPlane device. We recommend keeping firmware up to date for safety, performance, and compatibility. By initiating a firmware update you acknowledge that the update may temporarily affect device operation and that an interrupted update may require support to resolve. Do not operate the device during a firmware update.

9. Future Subscription Services

The App may in future offer optional premium features on a subscription basis. If introduced:

Subscription pricing and terms will be clearly disclosed before purchase
Payment will be processed by Apple In-App Purchase or Google Play Billing, subject to their respective terms
Subscriptions will auto-renew unless cancelled at least 24 hours before the renewal date
Cancellation and refund requests are subject to Apple App Store and Google Play Store policies

These Terms will be updated prior to any subscription features going live.

10. Intellectual Property

All intellectual property in the App — including software, design, graphics, logos, and content — is owned by or licensed to BLUEECHO MARINE – FZCO. The AquaPlane brand and product designs are proprietary. Nothing in these Terms transfers any intellectual property rights to you.

You retain ownership of all photos and videos you capture or upload. By uploading media to the App, you grant us a limited, non-exclusive licence to store and display that media solely within your account and as necessary to provide the App’s functionality. We do not claim ownership of your media and will not use it for any other purpose without your consent, except that we may access, review and remove content where necessary to enforce these Terms, comply with a legal obligation, or respond to a report of prohibited content.

11. Safety and Responsible Use

AquaPlane products are underwater propulsion devices. You are solely responsible for using your product safely and in accordance with the product manual and all applicable local laws and regulations. The App is a control and monitoring aid only and does not replace proper safety training, equipment checks, or diver judgment.

BLUEECHO MARINE – FZCO is not liable for injuries, accidents, or damage arising from use or misuse of AquaPlane products, with or without the App.

12. Disclaimers

The App is provided “as is” and “as available”. To the maximum extent permitted by law, BLUEECHO MARINE – FZCO makes no warranties, express or implied, including fitness for a particular purpose, uninterrupted availability, or error-free operation.

GPS and location data are provided for informational purposes only and should not be solely relied upon for navigation or safety decisions.

13. Limitation of Liability

To the maximum extent permitted by applicable law, BLUEECHO MARINE – FZCO shall not be liable for indirect, incidental, special, or consequential damages arising from use of the App, including any loss arising from content you have shared with other users. Our total liability shall not exceed the amount you paid (if any) for the App in the 12 months preceding the claim.

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

14. Third-Party Services and App Stores

The App is distributed via the Apple App Store and Google Play Store. Your use of those platforms is governed by Apple’s and Google’s own terms. In the event of any conflict between these Terms and App Store terms regarding the App, these Terms prevail to the extent permitted.

Apple has no obligation to provide maintenance or support for the App. In the event the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to the App.

Product claims. BLUEECHO MARINE – FZCO, not Apple, is responsible for addressing any claims relating to the App or your possession or use of it, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.

Intellectual property claims. In the event of any third-party claim that the App or your possession and use of it infringes that third party’s intellectual property rights, BLUEECHO MARINE – FZCO, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.

Legal compliance. You represent and warrant that you are not located in a country subject to a US Government embargo or designated by the US Government as a terrorist-supporting country, and that you are not listed on any US Government list of prohibited or restricted parties.

Third-party beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms Apple will have the right to enforce them against you as a third-party beneficiary.

15. Governing Law

These Terms are governed by the laws of the United Arab Emirates and the Emirate of Dubai. For EEA consumers, mandatory consumer protection laws of your country of residence also apply and are not affected by this clause.

Disputes shall be subject to the exclusive jurisdiction of the Dubai courts, except where applicable consumer law in your jurisdiction provides otherwise.

16. Termination

We may suspend or terminate your access to the App at any time for breach of these Terms, including for uploading prohibited content. You may terminate by deleting your account and uninstalling the App. Upon account deletion, your stored media will be deleted from our servers within a reasonable period. Sections relating to intellectual property, liability, and governing law survive termination.

17. Changes to These Terms

We may update these Terms at any time. Material changes will be notified via the App or by email. Continued use of the App after the effective date constitutes acceptance of the updated Terms.

18. General

Severability. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and BLUEECHO MARINE – FZCO regarding the App, and supersede any prior agreements or understandings relating to it.

Assignment. You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition or sale of assets, on notice to you.
